Terms of Service

Welcome to Local Flavor Films + Photography ("Company", "we", "our", "us"). These Terms and Conditions ("Terms") govern your use of our services and website located at localflavorfilms.com. By using our site or services, you (“Client”, “you”, “your”) agree to these Terms.

1. Communications

By creating an account or booking a session, you agree to receive emails from us related to scheduling, delivery, marketing, or service updates. You may unsubscribe from promotional emails at any time using the link in those messages, though we’ll still email you regarding your active bookings and deliveries.

2. Purchases

When making a purchase through our website, you may be asked for payment and billing details including credit card number, expiration date, security code, and billing address. All prices are listed in USD. Charges will appear as from “Local Flavor Films” on your bank or credit card statements. Payment is due upon delivery of the media unless otherwise arranged.

3. Property Access & Preparation

By booking a session, you confirm that you have authority to grant us access to the property. The property should be cleaned, staged, and photo-ready. We do not move furniture or perform cleaning. All pets must be removed or secured during the session. Any special shot requests must be submitted at least 24 hours in advance.

4. Cancellations, Reschedules & Late Arrivals

  • Reschedules due to weather or emergencies are allowed at no charge if made at least 2 hours before the shoot (at our discretion).
  • Cancellations for non-weather reasons must be made at least 24 hours in advance to avoid fees.
  • Less than 24 hours’ notice: A $175 cancellation/reschedule fee applies.
  • On-site cancellations or unready properties (including loose pets or other contractors present): Full shoot fee will be charged.

5. Turnaround & Delivery

Media will be delivered via a downloadable gallery in JPEG and/or MP4 format.

  • Agents and brokers: Media is typically delivered by 8 PM the next day.
  • Short-term rentals, builders, and developers: Delivery is within 3 business days.
  • Social campaigns or multi-format video packages: These may take a bit longer so we can ensure everything is tailored, polished, and platform-ready.

6. Copyright & Intellectual Property

All content created by Local Flavor Films + Photography—including photos, videos, 3D tours, floor plans, and virtual staging—is protected under U.S. copyright law and owned by Local Flavor Films + Photography.

Clients are granted a limited-use license based on the type of project purchased. Unless explicitly agreed to in writing, no media may be resold, altered, or repurposed outside the scope of the original agreement.

7. Licensing & Usage Restrictions

    A. Single-Use License (Residential Listings)

    • Applies to licensed Realtors and Brokers marketing a residential property for sale.
    • Valid for up to one year, or until the home is sold or removed from the MLS—whichever comes first.
    • Media may be used for MLS, social media, and self-promotion of the listing agent.
    • Not transferable to other agents, sellers, or third parties without written consent.
    • No resale, sublicensing, or gifting of content to other vendors (e.g., stagers, architects, builders, new listing agents, etc.).
    • Homes must be photo-ready and staged in advance, as these projects follow a standardized shoot flow.

    B. Multi-Use License (Commercial Use)

    • Applies to builders, developers, short-term rental owners, and businesses using content for broader brand marketing.
    • Valid for up to 10 years from date of delivery.
    • Content may be used across multiple platforms, including websites, paid advertising, social media, and print materials.
    • Not transferable or sub-licensable to other entities without prior written agreement.
    • Ideal for ongoing marketing or repeat use across properties, portfolios, or promotional channels.
    • These projects often require on-site coordination and custom direction.

    C. Restrictions for All Licenses

    • Content may not be altered or edited, except for basic cropping and resizing, without our written approval.
    • Media may not be uploaded to platforms that strip metadata or claim derivative rights.
    • Do not submit our content to AI training platforms, automated render services, or external editors without prior approval.
    • Unauthorized use or distribution constitutes copyright infringement and may result in revoked licenses or legal action.

    8. Client Responsibility at Shoot

    You or a representative must be present if specific shots or preferences are needed. If no one is present, our interpretation will be deemed acceptable.

    9. Indemnification

    You agree to indemnify and hold harmless Local Flavor Films + Photography and its team against any claims, losses, or legal fees resulting from misuse of our content or services, including property access or licensing violations.

    10. Revisions

    We reserve the right to update these Terms at any time. Continued use of our services constitutes acceptance of any changes.

    11. Limitation of Liability

    We are not liable for indirect, incidental, or consequential damages, including but not limited to:

    • Delays due to weather, access, or third-party platforms
    • Misuse or unauthorized editing of our content
    • Platform-specific terms of use (e.g., MLS or social media algorithms)

    Our total liability will not exceed the amount paid for the service.

    12. Governing Law

    These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles.
